Tax Crimes in Asset Seizure Draft Law: Purbaya‘s Warning

JAKARTA, DDTCNews — Minister of Finance, Purbaya Yudhi Sadewa, considers that confiscation under the Asset Seizure Draft Law cannot be automatically applied to all tax crimes.

According to Purbaya, the confiscation of assets belonging to taxpayers must be implemented with caution. He views confiscation should not be applied to those who have committed a violation for the first time.

"One should not have everything taken away for a single offence. There must be a principle of fairness. If it happens repeatedly or is clearly intended to deceive, then perhaps so," he said on Tuesday (8/9/2026).

Therefore, Purbaya continued, the confiscation of assets from perpetrators of tax crimes under the Asset Seizure Draft Law must be underpinned by clear guidelines.

"If it is to be applied, there must be clear guidelines. We must not make things difficult for ordinary people who sometimes forget or are negligent," he said.

For information, the Asset Seizure Draft Law currently being drafted by Commission III of the House of Representatives is not only targeting perpetrators of corruption crimes, but also other crimes, including those in the field of taxation.

In general, the Asset Seizure Draft Law will target crimes that are economically motivated, detrimental to the state and the wider public or that are of a high level of seriousness and have an impact on the public.

There are 13 crimes covered under the Asset Seizure Draft Law, namely:

1. corruption crimes;
2. narcotics and psychotropic crimes;
3. terrorism crimes;
4. human smuggling crimes;
5. crimes involving the smuggling of weapons, ammunition, and hazardous materials;
6. crimes in the forestry sector;
7. crimes in the environmental sector;
8. crimes in the field of taxation;
9. crimes in the banking sector;
10. crimes in the insurance sector;
11. crimes in the mining sector;
12. crimes in the maritime and fisheries sector; and/or
13. human trafficking crimes.

The House has committed to completing the Asset Seizure Draft Law by December 2026. (rig)
