Purbaya on Patriot Bond Purchases Exempt from Tax Prosecution
JAKARTA, DDTCNews - Minister of Finance, Purbaya Yudhi Sadewa, has responded to questions regarding the purchase of Patriot Bonds and Merah Putih Bonds, which are to be protected from general criminal prosecution, tax criminal prosecution and civil lawsuits.
Purbaya stated that the government will not scrutinise the source of funds invested by investors through the purchase of the special securities issued by BPI Danantara. He noted that incoming funds will be managed to stimulate the domestic economy.
"The money used to purchase Patriot Bonds will not have its source questioned, but if someone has other businesses, those may continue to be pursued [for law enforcement]," he said in the Tanjung Priok area on Tuesday (23/6/2026).
Purbaya conveyed that state protection applies only to investors purchasing Danantara's special securities. In terms of non-special securities, law enforcement authorities are authorised to pursue businesspeople and investors and bring them before a court if they commit violations.
Please note that the government has recently enacted Law 4/2026 concerning the Amendment to Law 4/2023 concerning the Development and Strengthening of the Financial Sector (P2SK). Under this new legal framework, the government allows BPI Danantara to issue securities.
The securities issued by Danantara comprise general securities as well as special securities, such as Patriot Bonds and Merah Putih Bonds.
Referring to Law 4/2026, every purchase of special securities by an investor constitutes a lawful transaction within the national financial system. In line with this, the state provides protection for the purchase of such special securities.
"The state shall guarantee and protect the purchase of special securities ... from general criminal prosecution, special criminal prosecution, including tax criminal prosecution and from civil lawsuits," reads Article 50A paragraph (5) of Law 4/2026.
Moreover, Law 4/2026 also provides that data and information from special securities purchase activities cannot be used as a tax base, nor can they be used as legal evidence in litigation before a court.
On another note, state protection over the purchase of special securities applies only to transactions conducted on the primary market. (rig)
